Issue/Request:
An Ordinance approving a Transportation Alternatives Program Supplemental Agreement between the City of Lee's Summit, Missouri, and the Missouri Highways and Transportation Commission related to the public improvement project designated as Federal Project Number TAP-3001(006), Complete Street Improvements: Douglas Street - Chipman Road to 2nd Street, within the City limits of Lee's Summit, Missouri and authorizing the Mayor to execute the same.
Key Issues:
• Pursuant to the FY2023 Capital Improvement Plan and Thoroughfare Master Plan, the City planned for improvements along Douglas Street between Chipman Road and 2nd Street to enhance safety, revitalize the downtown area and accommodate non-motorized transportation (hereinafter "Project").
• The Missouri Highways and Transportation Commission (hereinafter "MoDOT") approved the City's submittal of the Project for Transportation Alternatives Program federal funding in the amount of $900,000 (hereinafter "Federal Project Number TAP-3001(006)")
• An agreement between the City and MoDOT necessary to memorialize the mutual covenants, promises, and representations for Federal Project Number TAP-3001(006) for the Transportation Alternatives Program (hereinafter “TAP Funding Agreement”) was authorized in Bill No. 23-085.
• A supplemental agreement to the TAP Funding Agreement is necessary between the City and MoDOT to adjust Exhibit B - Project Schedule of the TAP Funding Agreement.

I move to recommend to City Council approval of an Ordinance approving a Transportation Alternatives Program Supplemental Agreement between the City of Lee's Summit, Missouri, and the Missouri Highways and Transportation Commission related to the public improvement project designated as Federal Project Number TAP-3001(006), Complete Street Improvements: Douglas Street - Chipman Road to 2nd Street, within the City limits of Lee's Summit, Missouri and authorizing the Mayor to execute the same.

FIRST MOTION: I move for second reading of an Ordinance approving a Transportation Alternatives Program Supplemental Agreement between the City of Lee's Summit, Missouri, and the Missouri Highways and Transportation Commission related to the public improvement project designated as Federal Project Number TAP-3001(006), Complete Street Improvements: Douglas Street - Chipman Road to 2nd Street, within the City limits of Lee's Summit, Missouri and authorizing the Mayor to execute the same.
SECOND MOTION: I move for adoption of an Ordinance approving a Transportation Alternatives Program Supplemental Agreement between the City of Lee's Summit, Missouri, and the Missouri Highways and Transportation Commission related to the public improvement project designated as Federal Project Number TAP-3001(006), Complete Street Improvements: Douglas Street - Chipman Road to 2nd Street, within the City limits of Lee's Summit, Missouri and authorizing the Mayor to execute the same.
Background:
Improvements to Douglas Street were approved by voters as part of the 2017 Capital Improvement Project Sales Tax Renewal. The project will enhance safety and operations with the addition of complete street elements including a shared-use path, sidewalk, ADA improvements, street lighting, significant landscaping/trees and access management modifications. The City’s Comprehensive Plan and Greenway Master Plan include and support the project. The project also supports the City's Livable Street Policy adopted by City Council Resolution.
The project will re-construct approximately 0.8 miles of Douglas Street from 2nd Street to Chipman Road. It will significantly improve the accessibility, safety and operation of the corridor for all users. It will replace and improve the deteriorating infrastructure conditions; including pavements, curbs, sidewalk, sewer, water and storm water. The project will help to address storm water capacity and flooding challenges. The project will provide for new user amenities and facilities that will highlight the corridor as a principal gateway into Downtown Lee's Summit. The street improvements will incorporate several livable street features and coordinate with the Greenway Master Plan and Bicycle Transportation Plan; both adopted in the City's Comprehensive Plan and advance the City's Strategic Plan Ignite!. Ancillary work included temporary and permanent easement and permanent Right-of-Way acquisition. Acquisitions for the project, impacting approximately 70 properties, were all completed without the need of a condemnation order. Project construction is expected to begin in Summer 2026.
The Mid-America Regional Council (MARC) announced a call for projects to compete for Missouri Transportation Alternatives Program federal funding in Fiscal years 2025/2026. The Douglas Street project was submitted as a candidate project for federal funding. The project scored very well because of the safety improvements, addition of multi-modal elements, and proximity to environmental justice tracts and activity centers. As a result, the project was allocated $900 thousand dollars for construction work.
The project has followed a design, bid, build process and undergone required state and federal review in consideration and compliance with the grant. The design, bid, build process is typical for these types of horizontal infrastructure projects to deliver a quality project on schedule and within budget while maximizing competitive pricing and adherence to all laws. The designer was selected using a mandated RFQ process. The construction contractor will be selected on the basis of a qualified, lowest and best bid through an open and public bid process.
Impact/Analysis:
Entering into the agreement allows the City to adjust Exhibit B, the project schedule to receive federal money for the Douglas Street improvements. Failure to do so would result in the City forfeiting that money.
