Issue/Request:
An Ordinance approving a Development and Land Transfer Agreement by and between the City of Lee's Summit, Missouri, and Hunt Midwest Real Estate Development, Inc. for the transfer of two parcels and three easements for the Mouse Creek Trail expansion and SW Pryor Road stormwater and multimodal projects improvements, and authorizing the Mayor to execute the same.
Key Issues:
• The Lee’s Summit Parks and Recreation Department has developed engineering plans to construction a multi-modal trail for public use along Mouse Creek near Pryor Road; and
• The City’s Public Works Department has included a grade separated trail crossing under Pryor Road as part of the Pryor Road Improvements project currently under construction; and
• Additional easements and property must be acquired to complete trail and stormwater improvements to support these projects; and
• The Lee’s Summit Parks and Recreation Board, the City’s Public Works Department, and Hunt Midwest Real Estate Development, Inc. (hereinafter “Hunt”) have negotiated a Development and Land Transfer Agreement (“Agreement”) that contemplates Hunt transferring parcels of land to the City containing multimodal trail easements, stormwater easements, and temporary construction easements; and,
• This Ordinance will authorize the City to complete the necessary land transfer agreements to build these projects.
Proposed Council Motion:
FIRST MOTION: I move for second reading of an Ordinance approving a Development and Land Transfer Agreement by and between the City of Lee's Summit, Missouri, and Hunt Midwest Real Estate Development, Inc. for the transfer of two parcels and three easements for the Mouse Creek Trail expansion and SW Pryor Road stormwater and multimodal projects improvements, and authorizing the Mayor to execute the same.
SECOND MOTION: I move for adoption of an Ordinance approving a Development and Land Transfer Agreement by and between the City of Lee's Summit, Missouri, and Hunt Midwest Real Estate Development, Inc. for the transfer of two parcels and three easements for the Mouse Creek Trail expansion and SW Pryor Road stormwater and multimodal projects improvements, and authorizing the Mayor to execute the same.
Background:
The Parks and Recreation Department has been pursuing for several years a trail construction project along Mouse Creek. The trail will start in the Whispering Woods subdivision east of Pryor Road, cross Pryor Road, and then continue west to Sampson Road. This trail will serve several subdivisions with connections to two City parks, the Longview Lake park area, and access to the network of shared use paths/trails proposed along Pryor Road.
At the same time the Parks Department was developing trail plans, the Public Works Department developed plans to improve Pryor Road between Hook Road and Longview Road. When both projects were initially listed in the City’s Capital Improvement Plan, they had separate timelines due to funding limitations. Both the Trail and Pryor Road projects received federal grants that allowed each project to move forward at about the same time. When Pryor Road was awarded an additional $14 million in federal grant money, the desired trail tunnel under Pryor Road became financially feasible to construct with the Pryor Road project in coordination with the Trail project.
Several departments began coordinating design, construction, funding, and land acquisition needed to build the trail and the tunnel. Hunt Midwest, as the owner of the adjacent land where the Trail would be partly constructed and where the tunnel construction limits would impact, was also undertaking work in this area as part of the Hook Farms subdivision project. Development Services, Law Department, Public Works, Parks and Recreation, and Hunt Midwest were able to coordinate the three separate projects into this one agreement to allow each project to be completed as desired by each party.
Impact/Analysis:
This agreement will allow all the parties to complete the desired improvements for the new trail, the trail crossing under Pryor Road, and finalize the Hook Farms subdivision project. If not approved, then the trail will be re-routed to cross Pryor Road at a signalized intersection, the trail tunnel will not be built, and Hook Farms will still be able to finalize the subdivision work as currently approved.
