Issue/Request:
An Ordinance approving Modification No. 3 to an Agreement for Professional Engineering Services for Douglas Road Improvements - 2nd Street to Chipman Road (RFQ No. 2022-061), between the City of Lee's Summit, Missouri, and Kimley-Horn, for an increase of $93,730.00 with an amended amount of $1,442,048.00 and authorizing the City Manager to execute an agreement for the same.
Key Issues:
• The City and Kimley-Horn and Associates, (hereinafter "Engineer") entered into an Agreement for Professional Engineering Services for the Douglas Road Improvements - 2nd Street to Chipman Road Project (RFQ No. 2022-061) dated October 27, 2022 (hereinafter "Base Agreement").
• The City and Engineer modified the Base Agreement pursuant to Modification No. 1 and 2, dated November 30, 2023 and March 28, 2024, respectively, for additional design scope and visual renderings.
• City staff has determined the necessity to incorporate construction and engineering administration support services (hereinafter “Services”).
• Engineer has submitted a proposal with estimated costs to provide the Services.
• The City desires to further modify the Base Agreement, as amended, with Engineer for the Services (hereinafter “Modification No. 3”).

I move to recommend to the City Council approval of an Ordinance approving Modification No. 3 to an Agreement for Professional Engineering Services for Douglas Road Improvements - 2nd Street to Chipman Road (RFQ No. 2022-061), between the City of Lee's Summit, Missouri, and Kimley-Horn, for an increase of $93,730.00 with an amended amount of $1,442,048.00 and authorizing the City Manager to execute an agreement for the same.

FIRST MOTION: I move for a second reading of an Ordinance approving Modification No. 3 to an Agreement for Professional Engineering Services for Douglas Road Improvements - 2nd Street to Chipman Road (RFQ No. 2022-061), between the City of Lee's Summit, Missouri, and Kimley-Horn, for an increase of $93,730.00 with an amended amount of $1,442,048.00 and authorizing the City Manager to execute an agreement for the same.
SECOND MOTION: I move for adoption of an Ordinance approving Modification No. 3 to an Agreement for Professional Engineering Services for Douglas Road Improvements - 2nd Street to Chipman Road (RFQ No. 2022-061), between the City of Lee's Summit, Missouri, and Kimley-Horn, for an increase of $93,730.00 with an amended amount of $1,442,048.00 and authorizing the City Manager to execute an agreement for the same.
Background:
The City and Kimley-Horn entered into an Agreement dated October 27, 2022, (RFQ No. 2020-06) for Professional Engineering Services for the Douglas Road Improvements project. To date, the Base Agreement has been modified two times to cover additional design scope and visual renderings as directed by the City.
The ITS Department is working with the Public Works Department to install new conduits for fiber optic cabling along Douglas Road as part of the City's communication network improvements. Adding this work to the Douglas Road Improvements project is a construction cost saving opportunity, but requires additional work from Kimley-Horn to update the construction plan set.
The City is preparing to advertise the construction contract for the Douglas Road Improvement project. All easement and right-of-way acquisitions have been completed. With that construction contract, the contractor will be required to submit shop drawings and material certifications that must be reviewed by Kimley-Horn to ensure conformance with project plans and specifications. Kimley-Horn will also need to attend periodic construction meetings, respond to contractor’s Requests for Information, and prepare post-construction record drawings. This contract amendment will add the ITS fiber installation and construction services to the scope of work which are not currently included in the contract and necessary to complete this project. The project is being delivered using a design-bid-build process. The design is nearly completed. All right-of-way has been acquired. Utility relocation is partly done. Bidding will commence upon MoDOT approval of the final plans, specifications and estimate (PS&E). Federal funding has been obligated. Construction is anticipated to begin late Spring or early Summer.
Impact/Analysis:
This agreement will allow Kimley-Horn to provide the City with construction and engineering related administrative services identified in the attached scope (Exhibit A).
