Issue/Request:

An Ordinance approving Change Order No. 8 to the agreement for the 3rd Street Improvements from Blue Parkway to Jefferson Street project, Project No. 575, between the City of Lee's Summit, Missouri and Miles Excavating, Inc., to increase the project timeline by two days and contract amount by $16,392.81 and to adjust item quantities due to additional work from Addendum No. 1, and authorizing the City Manager to execute an agreement for the same.  

 

Key Issues:

• Pursuant to Ordinance No. 10033, the City and Miles Excavating, Inc. (hereinafter "Contractor") entered into an agreement for the construction of the 3rd Street Improvements from Blue Parkway to Jefferson Street project, Project No. 575 (hereinafter "Base Agreement").

• The City and Contractor modified the Base Agreement, as amended, per Change Orders 1 through 7 administratively in accordance with the City's Procurement Policy. 

• The City desires to further modify the Base Agreement, as amended, to adjust the construction contract time and price to allow for changes needed on Addendum No. 1.

 

Proposed Committee Motion:

I move to recommend to City Council approval of an Ordinance approving Change Order No. 8 to the agreement for the 3rd Street Improvements from Blue Parkway to Jefferson Street project, Project No. 575, between the City of Lee's Summit, Missouri and Miles Excavating, Inc., to increase the project timeline by two days and contract amount by $16,392.81 and to adjust item quantities due to additional work from Addendum No. 1, and authorizing the City Manager to execute an agreement for the same.

 

Proposed City Council Motion:

FIRST MOTION: I move for a second reading of an Ordinance approving Change Order No. 8 to the agreement for the 3rd Street Improvements from Blue Parkway to Jefferson Street project, Project No. 575, between the City of Lee's Summit, Missouri and Miles Excavating, Inc., to increase the project timeline by two days and contract amount by $16,392.81 and to adjust item quantities due to additional work from Addendum No. 1, and authorizing the City Manager to execute an agreement for the same.

SECOND MOTION: I move for adoption of an Ordinance approving Change Order No. 8 to the agreement for the 3rd Street Improvements from Blue Parkway to Jefferson Street project, Project No. 575, between the City of Lee's Summit, Missouri and Miles Excavating, Inc., to increase the project timeline by two days and contract amount by $16,392.81 and to adjust item quantities due to additional work from Addendum No. 1, and authorizing the City Manager to execute an agreement for the same.

 

Background:

The Project includes pavement and sidewalk reconstruction, the addition of a 10’ shared multi-use path, storm sewer replacement, utility relocations and grading.  The main purpose of this Project is safety and storm improvements.

Change Order No. 1 was approved administratively due to a change in contract price and time at the intersection of SW 3rd St and Jefferson St. 

Change Order No. 2 was approved administratively to change contract price due to additional tree removals and additional traffic control.

Change Order No. 3 was approved administratively to change the contract price and time for additional barricades, pavement markings, light poles and RCP quantities.

Change Order No. 4 was approved administratively to change contract price due to a additional tree removals and additional work due to utility conflicts on SW Lakeview Blvd.

Change Order No. 5 was approved administratively due to change contract price for additional signage, additional curb and pavement removal, additional concrete pavement installation, and to incorporate a revised plan sheet into the contract.

Change Order No. 6 was approved administratively due to a need for material changes to complete water service connections, unsuitable soil corrections, additional temporary pavement markings, increase in item quantities and an increase in time.

Change Order No. 7 was approved administratively due to additional work needed, additional removals, increases in pay item quantities and time for additional work.

The cumulative amounts of Change Orders 1 through 7 totaled $305,588.80 of added cost to the project. This amount is 4.8% of the $6,249,762.81 base bid.

This change, Change Order No. 8, will address adding two additional calendar days to construction contract time to allow for the impeded progress throughout the project due to utility relocation delays. The base contract allotted 545 days to reach substantial completion. Change Order 8 will extend the time by two Calendar days to reach substantial completion. The City’s Procurement Policy states that the City Council must approve any change order (i) resulting in an increase to the contract time exceeding the greater of 30 days or a certain percent (%) of the original contract time as described by policy, or (ii) a single change order increasing contract time by 90 days or more. This change order 8 meets both criteria to require Council approval.
