Issue/Request:
An Ordinance approving Change Order No. 6 to the Agreement for Project No. 177 for the Olive and Orchard Road and Storm Sewer Improvements with VF Anderson Builders, LLC, for an increase in the contract price of $45,267.00, for a revised agreement amount of $5,736,347.14 and to increase the project timeline by 67 days, and authorizing the City Manager to execute an agreement for the same.
Key Issues:
• Pursuant to Ordinance No. 10321, the City and VF Anderson Builders, LLC (hereinafter "Contractor") entered into an Agreement for the construction of Project No. 117 for the Olive and Orchard Road and Storm Sewer Improvements Project (hereinafter "Base Agreement") in the amount of $5,430,314.00.
• The City and Contractor modified the Base Agreement, as amended, per Change Orders 1 through 5 administratively in accordance with the City's Procurement Policy.
• The City desires to further modify the Base Agreement, as amended, due to additional costs associated with added work and to adjust construction contract time.

FIRST MOTION: I move to recommend to City Council approval of an Ordinance approving Change Order No. 6 to the Agreement for the construction of the Olive and Orchard Road and Storm Sewer Improvements with VF Anderson Builders, LLC, for an increase in the contract price of $45,267.00, for a revised agreement amount of $5,736,347.14 and to increase the project timeline by 67 days, and authorizing the City Manager to execute an agreement for the same.
SECOND MOTION: I move for adoption of an Ordinance awarding the Change Order No. 6 for Project No. 117 for the Olive and Orchard Road and Storm Sewer Improvements with VF Anderson Builders, LLC, for an increase in the contract price of $45,267.00, for a revised agreement amount of $5,736,347.14 and to increase the project timeline by 67 days, and authorizing the City Manager to execute an agreement for the same.
Background:
The primary purpose of this project is to address structural flooding near the corner of Olive and Orchard. The secondary purpose is to reconstruct Olive and Orchard streets to enhance roadway safety, improve traffic operations, connect gaps in current bicycle facilities, and create walkable routes. An older City water main and several brick manholes within the corridor will also be replaced with the project.
This Change Order 4 will adjust the contract price for additional costs and time associated with added unforeseen field conditions and delays caused by utility conflicts. The overall cost will increase by $45,267.00. for a revised Agreement amount of $5,736,347.14. The combined increase of Change Orders 1 through 6 would be $306,033.14, which is a 5.6% increase over the Base Agreement amount.
Impact/Analysis:
Additional costs due to the excavation required to replace the previously unknown sanitary sewer service line and related tree removal. Public Works staff agrees to the contractor's request to increase the contract times by 67 days for construction delays caused by conflicts with gas lines along NW Olive St. The increase in contract time accounts for any and all delays up to the date of August 28, 2026. This is the date Spire completed their relocate work for all known conflicts.
