Issue/Request:
An Ordinance authorizing the execution of a Surface Transportation Block Grant Program Funding Agreement between the City of Lee's Summit, Missouri, and the Missouri Highways and Transportation Commission related to the public improvement project designated as Federal Project Number STBG 3338(407), Scherer Road Reconstruction - Ward Road to Jefferson Street, within the City limits of Lee's Summit, Missouri and authorizing the Mayor to execute the same.
Key Issues:
Pursuant to the FY2024 Capital Improvement Plan and Thoroughfare Master Plan, the City planned for improvements along Scherer Road between Ward Road and Jefferson St to improve safety, traffic operations, and accessibility; provide a multimodal transportation option and rehabilitate existing pavement (hereinafter "Project").
The Missouri Highways and Transportation Commission ("hereinafter MoDOT") approved the City's submittal of the Project for Surface Transportation Block Grant (STBG) program federal funding in the amount of $4,100,000 (hereinafter "Federal Project Number STBG 3338(407)")
An agreement between the City and MoDOT is necessary to memorialize the mutual covenants, promises, and representations for Federal Project Number STBG 3338(407) for the STBG Program (hereinafter “STBG Funding Agreement”).
The attached agreement is included for reference. MoDOT requires the agreement to be executed in DocuSign.

FIRST MOTION: I move for second reading of an Ordinance approving a Surface Transportation Block Grant Program Funding Agreement between the City of Lee's Summit, Missouri, and the Missouri Highways and Transportation Commission related to the public improvement project designated as Federal Project Number STBG 3338(407), Scherer Road Reconstruction - Ward Road to Jefferson Street, within the City limits of Lee's Summit, Missouri and authorizing the Mayor to execute the same.
SECOND MOTION: I move for adoption of an Ordinance approving a Surface Transportation Block Grant Program Funding Agreement between the City of Lee's Summit, Missouri, and the Missouri Highways and Transportation Commission related to the public improvement project designated as Federal Project Number STBG 3338(407), Scherer Road Reconstruction - Ward Road to Jefferson Street, within the City limits of Lee's Summit, Missouri and authorizing the Mayor to execute the same.
Background:
Improving SW Scherer Rd from M-291 to Sampson Rd to interim roadway standards was approved by voters as part of the 2017 CIP Sales Tax renewal election in November 2017. In April of 2023, voters approved a No Tax Increase Bond issue, which combined with the 2017 sales tax funds, Surface Transportation Block Grant (STBG), and Water Construction Fund (316) will fund the full reconstruction of SW Scherer Rd.
The project will re-construct approximately 1 mile of SW Scherer Rd from M-291 to SW Ward Rd, as shown in the City’s 2006 and 2016 Thoroughfare Master Plan documents. Improvements will include widening the roadway to three lanes, vertical alignment improvements, sidewalks, storm infrastructure upgrades, and water system improvements.
The primary reasons for this project are to enhance safety and operations with the addition of complete street amenities to include sidewalk, ADA improvements, and lighting as well as access management modifications. An older City water main and aging stormwater infrastructure within the corridor will also be replaced with the project.
This project supports improved safety, operations, community growth and livability in southwest Lee’s Summit. The project is identified in the Thoroughfare Master Plan, the Greenway Master Plan and Bicycle Transportation Plan. This project intersects the Rock Island Trail and future trailhead. The later phase(s) of the project will connect with Longview Lake. Increased land development, traffic demand and use by cyclists and pedestrians along this corridor is cause for its forthcoming capacity issues and impediment to further community growth.
The Mid-America Regional Council (MARC) announced a call for projects to compete for Surface Transportation Block Grant federal funding in federal Fiscal years 2027 and 2028. The Lakewood Way project was submitted as a candidate and scored very well because of the safety improvements, addition of multi-modal elements, and proximity to activity centers. As a result, the project was allocated $4,100,000 dollars for construction work in fiscal year 2028.
Impact/Analysis:
Entering into the Agreement allows the City to receive federal money for the Scherer Road Reconstruction - Ward Road to Jefferson Street project. Failure to do so would result in us forfeiting that money.
