Issue/Request:
An Ordinance approving an Intergovernmental Agreement Regarding Maintenance of Streetlights by and between the City of Lee’s Summit, Missouri, and the Missouri Highways and Transportation Commission for North Outer Road 50 W (also known as Blue Parkway) located east of Blackwell Road, and authorizing the Mayor to execute an agreement for the same.
Key Issues:
• The Commission owns and operates, as part of the State Highway System, North Outer Road 50 W (also known as Blue Parkway) located east of Blackwell Road.
• The City is desirous of performing certain tasks related to the installation and maintenance of streetlight improvements.
• The City proposes and the Commission will allow the installation by private developer and maintenance by City of streetlight improvements on Commission right-of-way.
• All improvements made pursuant to this Agreement within the state-owned right-of-way shall become the Commission's property. The City, at its sole cost and expense, is responsible for maintaining all streetlights constructed or installed pursuant to this Agreement in fully operational, safe, and aesthetically acceptable condition.
Proposed Committee Motion:
I move to recommend to City Council approval of an Ordinance approving an Intergovernmental Agreement Regarding Maintenance of Streetlights by and between the City of Lee’s Summit, Missouri, and the Missouri Highways and Transportation Commission for North Outer Road 50 W (also known as Blue Parkway) located east of Blackwell Road, and authorizing the Mayor to execute an agreement for the same.
Proposed City Council Motion:
FIRST MOTION: I move for a second reading of an Ordinance approving an Intergovernmental Agreement Regarding Maintenance of Streetlights by and between the City of Lee’s Summit, Missouri, and the Missouri Highways and Transportation Commission for North Outer Road 50 W (also known as Blue Parkway) located east of Blackwell Road, and authorizing the Mayor to execute an agreement for the same.
SECOND MOTION: I move for adoption of an Ordinance approving an Intergovernmental Agreement Regarding Maintenance of Streetlights by and between the City of Lee’s Summit, Missouri, and the Missouri Highways and Transportation Commission for North Outer Road 50 W (also known as Blue Parkway) located east of Blackwell Road, and authorizing the Mayor to execute an agreement for the same.
Background:
The City requires streetlights be installed as part of the proposed development, Residences at Blackwell. Commission will not allow streetlights to be constructed unless City accepts responsibility for the future maintenance of streetlights in MoDOT’s right of way.
Impact/Analysis:
In the event that the development does not move forward, streetlights will not be installed and agreement is no longer required.
