An Ordinance approving Change Order No. 4 to the agreement for the construction of Project No. 722 for the Water Main Replacement FY24 Project to Leath & Sons Inc. for an increase in the contract price of $120,635.91 for a revised agreement amount of $5,584,121.57 authorizing the City Manager to execute an agreement for the same.
Key Issues:
• Pursuant to Ordinance No. 10112, the City and Leath & Sons, Inc. (hereinafter "Contractor") entered into an Agreement for the construction of the Water Main Replacement: FY24 Project, Project No. 722, (hereinafter "Base Agreement").
• Pursuant change order approval process prescribed in the City’s Procurement Policy, the City and Contractor entered into Change Order No. 1 for additional time to show for substantial completion.
• Pursuant to Ordinance No. 10112, the City and Contractor executed Change Order No. 2 for work requiring additional funds to cover water main relocation, missing 20” tees and lack of current locates data.
• Pursuant change order approval process prescribed in the City’s Procurement Policy, the City and Contractor entered into Change Order No. 3 for overrun on items and asphalt mix change due to weather.
• The City desires to further modify the Base Agreement, as amended, due to additional costs associated with the added work.

I move to recommend to City Council approval of an Ordinance approving Change Order No. 4 to the agreement for Project No. 722 for the Water Main Replacement FY24 with Leath & Sons Inc. for an increase in the contract price of $120,635.91 for a revised agreement amount of $5,584,121.57 and authorizing the City Manager to execute an agreement for the same.

FIRST MOTION: I move to recommend to City Council approval of an Ordinance approving Change Order No. 4 to the agreement for the construction of Project No. 722 for the Water Main Replacement FY24 Project to Leath & Sons Inc. for an increase in the contract price of $120,635.91 for a revised agreement amount of $5,584,121.57 authorizing the City Manager to execute an agreement for the same.
SECOND MOTION: I move for the adoption of an Ordinance approving Change Order No. 4 to the agreement for the construction of Project No. 722 for the Water Main Replacement FY24 Project to Leath & Sons Inc. for an increase in the contract price of $120,635.91 for a revised agreement amount of $5,584,121.57 authorizing the City Manager to execute an agreement for the same.
Background:
This Change Order 4 will adjust the contract price for additional costs associated with added unforeseen field conditions with the water line replacement and the replacements of several private fire line connections. The overall cost will increase by $120,635.91 for a revised Agreement amount of $5,584,121.57.
It was determined that due to change in work for the Water Main Replacement FY24 it was decided to move ahead with overrun on items and asphalt mix change due to weather. These were required in order to complete the construction on time.
