An Ordinance approving an Intergovernmental Agreement by and between the City of Lee’s Summit, Missouri, and the City of Kansas City, Missouri, for the purpose of acquiring, constructing, and maintaining portions of NW Valley Garden Drive and NW Noland Road, and authorizing the Mayor to execute any and all documents on behalf of the City for the same.

Issue/Request:
This agreement will allow the Cities of Lee's Summit and Kansas City to cooperate in services and funding to acquire property, right-of-way (ROW) and/or easements for the establishment of a local public road and the establishment of said road for public access. Quarry Park Road, located in Lee's Summit, was closed due to unsafe conditions (e.g. collapse) and Quarry Park Road is currently the only public access in ROW for several properties located in Lee's Summit. In the interim, access easements and agreements have been executed for temporary access to those properties via private property and other uncertain easements located in Lee's Summit and/or Kansas City (e.g. Old Noland Road). A local public road would be established connecting Quarry Park Road to Bannister Road. In seeking a permanent solution for access, via a public roadway, Lee's Summit approached Kansas City to provide services in coordination for the acquisition of property, ROW and/or easements located within the Kansas City jurisdiction. These services, to which the terms are included in the attached Intergovernmental Agreement, would be rendered upon execution of the agreement by Kansas City and Lee's Summit.
Key Issues:
- With the approval of this agreement the City of Kansas City will assume the responsibility of providing services to acquire property, right of way (ROW), and other easements as required, for the establishment of a permanent public way funded by the City of Lee's Summit. The permanent public way (i.e. local roadway) will connect Quarry Park Road to Bannister Road.
- A local roadway would be constructed by Lee's Summit and the portions located in Kansas City would be maintained by Lee's Summit. Lee's Summit would design the improvements and receive permits for work through Kansas City.
- The project would be completed after acquisitions, which may require condemnation by Kansas City and Lee's Summit, prior to the expiration of temporary or interim access expires. Time is of the essence to begin the acquisition process coordinated by Kansas City and Lee's Summit as contemplated in the agreement.
- Lee's Summit would reimburse Kansas City for its costs associated with the project, including but not limited to those associated with acquisition and legal.
Proposed City Council Motion:
I move to recommend to City Council for approval of an Ordinance approving an Intergovernmental Agreement by and between the City of Lee’s Summit, Missouri, and the City of Kansas City, Missouri, for the purpose of acquiring, constructing, and maintaining portions of NW Valley Garden Drive and NW Noland Road, and authorizing the Mayor to execute any and all documents on behalf of the City for the same.
Background:
Quarry Park Road, located in Lee's Summit, was closed due to unsafe conditions (e.g. collapse). Quarry Park Road was an exclusive public way providing access to several properties located in Lee's Summit. The repair and restoration of Quarry Park Road is impractical due to the extent of damages and undermined areas. An interim public way has been established through several agreements and temporary easements routing public access through Kansas City to Bannister Road via Old Noland Road/Noland Road and/or during inclement weather, via private property circumventing the portion of Quarry Park Road that is closed to Pryor Road. Those temporary routes are effective until approximately the end of 2026. A new route for access was identified via Old Noland Road/Noland Road and Valley Garden Drive, a private way, located in Kansas City, between Quarry Park Road and Bannister Road. Since the proposed public access, which would be a public local road, travels through Kansas City and requires the acquisition of property, ROW and/or easements for the establishment and construction of said road, the cooperation and services of Kansas City is most desired. This agreement provides for those services by Kansas City which also may include condemnation. Lee's Summit would similarly acquire needed property, ROW and/or easements within its jurisdiction to fully establish the proposed local road.
Impact/Analysis:
This agreement will result in the cooperation by and between the City of Kansas City, MO, and Lee's Summit, MO, for the acquisition of property and/or ROW (easements) for the establishment of a new permanent public way connecting Bannister Road in Kansas City, MO, to Quarry Park Road in Lee's Summit, MO, for access to properties located in Lee's Summit. This agreement will also remain in effect after the completion of acquisition(s) whereby the City of Lee's Summit assumes maintenance responsibility in perpetuity for those parts of the new permanent public way located in Kansas City.
