Issue/Request:

A Resolution to repeal and replace Resolution 22-14 authorizing additional funds to the City of Lee's Summit Water Utilities and Public Works Department's application for grant funding from the Missouri Department of Natural Resources for the State of Missouri American Rescue Plan Act (ARPA) for Water Infrastructure Community Programs. 

 

Key Issues:

                     As part of the grant application, the Department of Natural Resources requests that the City of Lee's Summit received authorization through a City Council Resolution in conjunction with the submittal of applications

                     Resolution 22-14 authorized the City to receive $3,750,612.74 in ARPA grant funding for stormwater projects

                     The Federal fiscal year-end funding sweep made $795,387.50 of additional grant funding available for the Lee's Summit stormwater project previously awarded funds

                     The City of Lee’s Summit has been awarded a revised total amount of $4,546,000.00 in grant funds for the construction of the East Fork Little Blue Area 2 Stormwater Project and the EFLB Area 3 and Area 4 Stormwater Project

                     This resolution supports the City of Lee's Summit desire to modify the stormwater grant agreement with the Missouri Department of Natural Resources to receive additional grant funding 

 

Proposed Committee Motion:

I move to recommend to City Council approval of a Resolution to repeal and replace Resolution 22-14 authorizing additional funds to the City of Lee's Summit Water Utilities and Public Works Department's application for grant funding from the Missouri Department of Natural Resources for the State of Missouri American Rescue Plan Act (ARPA) for Water Infrastructure Community Programs.  

Proposed City Council Motion:

I move to adopt a Resolution to repeal and replace Resolution 22-14 authorizing additional funds to the City of Lee's Summit Water Utilities and Public Works Department's application for grant funding from the Missouri Department of Natural Resources for the State of Missouri American Rescue Plan Act (ARPA) for Water Infrastructure Community Programs.  

Background:

In 2022, The state legislature has appropriated $410m of its state ARPA funds to invest in Missouri's water infrastructure through community grant programs.  The Department of Natural Resources Financial Assistance Center has separated the ARPA grant programs for water and sewer infrastructure into four (4) grant programs with specific funding amounts.

                     - Drinking Water Infrastructure projects: $125m with a maximum award of $5m

                     - Wastewater Infrastructure projects: $125m with a maximum award of $5m

                     - Stormwater Infrastructure projects: $150m with a maximum award of $5m

                     - Lead Service Line Inventories: $10m with a maximum award of $200k

In 2022, the City was awarded a competitive ARPA grant through the Missouri Department of Natural Resources (MDNR) in the amount of $3,750,612.24. A condition of the grant was to award construction contract no later than December 31, 2024. Communities unable to meet that deadline could have the unspent grant money swept back to MDNR for re-allocation to other communities. The City has already been receiving grant reimbursements for engineering design on Sampson Road/Mouse Creek Stormwater Improvements project and construction for the East Fork of the Little Blue River Stormwater project. Those projects will not use all the ARPA stormwater grant money, so some of the grant money will help fund the Stormwater Improvements in Areas 3 and 4 of the East Fork of the Little Blue River watershed. This project is located near SE Todd George and 3rd Street (construct contract award will be presented to Public Works Committee on November 18, 2024).

Following a statewide funding sweep, MDNR contacted the City to ask if the Lee’s Summit could receive, and obligate, additional grant funding before December 31, 2024. The Area 3 and 4 project has capacity to for additional grand money, and it will meet the December 31st deadline to obligate construction the grant money. Therefore, MDNR want to award the City and additional $795,387.50 in ARPA stormwater grants to increase the City’s stormwater grant to a total of award to $4,546,000.00.

In order to receive the additional grant funding, the City Council must adopt a resolution in support of the additional grant funding.

The Public Works Committee voted unanimously 3-0 (Councilmember Rader "Absent"), to recommend to City Council approval of a Resolution to repeal and replace Resolution 22-14 authorizing additional funds to the City of Lee's Summit Water Utilities and Public Works Department's application for grant funding from the Missouri Department of Natural Resources for the State of Missouri American Rescue Plan Act (ARPA) for Water Infrastructure Community Programs.
