Title
An Ordinance exempting the City of Lee’s Summit, Missouri from the provisions of Section 311.2026 of the Revised Missouri Statutes regarding the extension of hours for liquor licensees to sell, serve, and allow the consumption of alcoholic beverages during the 2026 FIFA World Cup Tournament.
Body
Issue/Request:
Staff is recommending adopting new/temporary ordinance for Chapter 4, Alcoholic Beverages, Article I. In General Section 4-2 Hours of Sale-Generally of the Code of Ordinances of the City of Lee’s Summit, electing to “opt-out” or exempt the City of Lee’s Summit from the provisions of Missouri House Bill 1041, SB 753 (2025)
Key Issues:
Missouri House Bill 1041, signed into law, provides that for the duration of the 2026 FIFA World Cup Tournament, June 11, 2026, to July 19, 2026, holders of a liquor license for sale by the drink may operate 24 hours a day, and may serve alcoholic beverages between 6:00 a.m. and 5:00 a.m. of the following day.
The house bill also allows any city, county, district, or other political subdivision in the state that objects to the extension of hours to exempt itself by ordinance for the temporary period.
There are 170 businesses with a current liquor license. Of those, 109 would have extended hours under RSMo 311.2026 unless prohibited by a new local ordinance.
Extended late-night hours may increase alcohol related calls for service straining police and EMS services.
Extended late-night hours could increase noise complaints and neighborhood disturbances and may impact residents near the businesses or around the bar district.
Extended late-night hours may increase additional traffic in the bar district and the demands on parking
Proposed Committee Motion:
I move to recommend for approval to the City Council an Ordinance electing to exempt the City of Lee’s Summit from the provisions of the SB 753 (2025) authorizing extended alcohol service hours for the 2026 FIFA World Cup Tournament.
Background:
Missouri House Bill 1041, signed into law, provides that for the duration of the 2026 FIFA World Cup Tournament, June 11, 2026, to July 19, 2026, holders of a liquor license for sale by the drink may operate 24 hours a day, and may sell, and serve, and allow for the consumption of alcoholic beverages between 6:00 a.m. and 5:00 a.m. of the following day. This is a temporary extension of service and shall apply to all licensed areas at a licensed establishment.
Licensees are not required to apply to the commission for approval, and no special temporary licenses or permits are required of any licensee for purposes of this temporary extension but are subject to any local restrictions on hours of operation as provided under subsection 4 of this section or additional conditions for compliance under any applicable local laws, ordinances, rules or regulations.
Subsection 4 states, if any city, county, district, or other political subdivision in the state objects to the extension of hours or the licensees within its jurisdiction, the governing body of such political subdivision may exempt itself by ordinance from the provision of the section or may modify by ordinance the hours applicable to such political subdivision but not to exceed the hours allowed under the section. The house bill exception expires July 20, 2026.
Impact/Analysis:
Adopting an Opt-out/exempt ordinance would limit enforcement and fiscal impacts to the city related to the need to increase law enforcement staffing, overtime, and reduce liability related to additional exposure due to increased demands.
Adopting and Opt-out/exempt ordinance now would create clarity and set clear expectations for business and residents well before the event commences.
