Issue/Request:
AN ORDINANCE AUTHORIZING EXECUTION OF A MUNICIPAL AGREEMENT BY AND BETWEEN THE CITY OF LEE’S SUMMIT, MISSOURI AND THE MISSOURI HIGHWAYS AND TRANSPORTATION COMMISSION FOR CONSTRUCTION AND MAINTENANCE ACTIVITIES RELATED TO THE PUBLIC IMPROVEMENT PROJECT DESIGNATED AS ROUTE 50 AT ROUTE 291 SOUTH JUNCTION, JOB J4P2291, WITHIN THE CITY LIMITS OF LEE'S SUMMIT, MISSOURI.
Key Issues:
MoDOT will be re-constructing an interchange at Route 50 and Route 291 South Junction. The project also includes outer road improvements (Blue Parkway and Oldham Parkway).
This project is scheduled to begin construction in 2017.
The project work will be done in both City and MoDOT rights-of-ways.
An agreement between the City and MoDOT is necessary for MoDOT to the construct all the improvements and define maintenance responsibilities.

I move to recommend to the City Council approval of AN ORDINANCE AUTHORIZING EXECUTION OF A MUNICIPAL AGREEMENT BY AND BETWEEN THE CITY OF LEE’S SUMMIT, MISSOURI AND THE MISSOURI HIGHWAYS AND TRANSPORTATION COMMISSION FOR CONSTRUCTION AND MAINTENANCE ACTIVITIES RELATED TO THE PUBLIC IMPROVEMENT PROJECT DESIGNATED AS ROUTE 50 AT ROUTE 291 SOUTH JUNCTION, JOB NO. J4P2291, WITHIN THE CITY LIMITS OF LEE'S SUMMIT, MISSOURI.
Background:
The citizens of Lee's Summit approved a no-tax increase bond issue in the amount of $10M that will be allocated to improvements at the interchange of Route 50 and Route 291 South Junction. The City has obtained an additional $6.8M in funds for the project through the federal surface transportation program. The City and MoDOT have entered into a Cost Apportionment and Road Relinquishment Agreement, dated January 28, 2016, to define the financial cost share obligations and other terms of cooperation, ownership, maintenance, etc. in association with the project. MoDOT leads all design and construction activities associated with the improvements. MoDOT is also responsible for any cost overruns that exceed the budget. The City's total locally funded contribution to the project is capped at $8M. The total project cost estimate is $16M. The project is scheduled for construction to begin during the spring of 2017 and complete by the end of 2018.
Impact/Analysis:
This is a typical municipal agreement between the City and MoDOT with regard to highway interchange improvements. This agreement will allow MoDOT to work on City right-of-way and take temporary ownership of City right-of-way for the construction of improvements. The City is required to retain its existing interest in City right-of-way upon completion of the project and agrees to maintain those areas as well as all sidewalks and any additional improvements that exceed MoDOT normal standards (e.g. landscaping), with exception of sidewalk upon the bridge, upon project completion.
