An Ordinance awarding the bid for Project No. 576322-6C for the Stormwater Improvements: Phase 2 to Legacy Underground Construction, Inc. in the amount of $1,167,971.10, and authorizing the City Manager to execute an agreement for the same.

 

Key Issues:

 

                     City staff identified locations in the City where structural flooding occurs, including NW Ponderosa Street, NE Arlington Circle, and NE Country Lane.

                     The stormwater improvements at the three sites, as designed by Lamp Rynearson, Inc. pursuant to Ordinance No. 8926, includes installation of approximately 1300 feet of storm sewer pipe and 19 storm sewer structures (hereinafter "Project No.  576322-6C").

                     Project No. 576322-6C is funded from the CIP Sales Tax Fund that was approved by voters in April 2017 and became effective April 1, 2018.

                     PWE issued an advertisement for bids for the construction of Project No. 576322-6C on August 1, 2023, in accordance with local policies and state statues.

                     Legacy Underground Construction, Inc.  (hereinafter "Contractor") was evaluated to be the lowest and best bidder by City staff.

                     City desires to enter into an agreement with Contractor to construct Project No. 576322-6C.

 

Proposed City Council Motion:

FIRST MOTION: I move for a second reading of an Ordinance awarding the bid for Project No. 576322-6C for the Stormwater Improvements: Phase 2 to Legacy Underground Construction, Inc. in the amount of $1,167,971.10, and authorizing the City Manager to execute an agreement for the same.

 

 

 

SECOND MOTION: I move for adoption of an Ordinance awarding the bid for Project No. 576322-6C for the Stormwater Improvements: Phase 2 to Legacy Underground Construction, Inc. in the amount of $1,167,971.10, and authorizing the City Manager to execute an agreement for the same.

 

 

Background:

In April 2017, voters approved a 15-year extension of the Capital Improvement (CIP) Sales Tax.  This extension that started in 2018 was expanded to include storm water improvements.  To be eligible for the program, property owners are required to submit a written statement that their house flooded.  Residential properties on NW Ponderosa Street, NE Arlington Circle and NE Country Lane meet these conditions, so this storm water project was initiated to mitigate structural flooding.

 

This project, Storm water Improvements: Phase 2, will address structural flooding impacting multiple structures due to a lack of public infrastructure.  At NW Ponderosa Street there will be an addition of 2 area inlets at the backyard along with swale grading to direct sheet flow from the north towards the new inlets.  At the sag of NE Country Lane there will be up sizing of the public storm water system from the street to a channel in the backyards.  At NE Arlington Circle there will be up sizing of the public storm water system from the Arlington Circle cul-de-sac to the outfall in an existing concrete lined channel south of Ash Street.   

A unique element of this project at the Arlington Circle site is the presence of an existing storm water system that is comprised of storm water structures that have two pipes entering and a single pipe leaving.  This occurs at three separate structures along the improvements.  Additionally, a shallow double cell box culvert under Ash Street that was carrying vehicular traffic collapsed during preliminary design.  With the installation of the improvements, these irregularities will be replaced with a system that is not only able to convey the 100-yr event but also one that is more easily maintained by Public Works Operations in the future.

 

Impact/Analysis:

Public Works Engineering advertised for bids for Project No. 576322-6C on August 1, 2023.  This was posted on the City's website and on the QuestCDN website.   Three responsive bids were received by the August 22, 2023, bid opening date.  Bids were evaluated by staff and Legacy Underground Construction, Inc. was found to be the lowest and most responsible bidder.

Timeline:

Estimated contract start date for the Ponderosa Street site could be as early as October 2023.

Estimated contract start date for the Country Lane and Arlington Circle sites is expected to be March 2024.

Each site will have individual milestone dates.

The project will be substantially complete by the end of August 2024.
