Issue/Request:
An Ordinance approving Change Order No. 3 to the guaranteed maximum price (GMP) agreement for the Fire Stations 4 and 5 Project between the City of Lee's Summit, Missouri and McCown Gordon Construction to increase the project timeline by 40 days, and authorizing the City Manager to execute an agreement for the same.
Key Issues:
• Pursuant to Ordinance No. 9486, the City and McCown Gordon Construction (hereinafter "Contractor") entered into a guaranteed maximum price GMP agreement for the construction of the Fire Stations 4 and 5 Project.
• The City and Contractor modified the Base Agreement, as amended, per Change Order No. 1 administratively in accordance with the City's procurement Policy.
• The City and Contractor modified the base Agreement, as amended, per Change Order No. 2 administratively in accordance with the City's Procurement Policy.
• The City desires to further modify the Base Agreement, as amended, to adjust construction contract time due to utility and procurement delays.
Proposed Committee Motion:
I move to recommend to the City Council approval of an Ordinance approving Change Order No. 3 to the agreement with McCown Gordon Construction for the Fire Stations 4 and 5 Project to increase the project timeline by 40 days, and authorizing the City Manager to execute an agreement for the same.

FIRST MOTION: I move for a second reading of an Ordinance approving Change Order No. 3 to the agreement with McCown Gordon Construction for the Fire Stations 4 and 5 Project to increase the project timeline by 40 days, and authorizing the City Manager to execute an agreement for the same.
SECOND MOTION: I move for adoption of an Ordinance approving Change Order No. 3 to the agreement with McCown Gordon Construction for the Fire Stations 4 and 5 Project to increase the project timeline by 40 days, and authorizing the City Manager to execute an agreement for the same.
Background:
The factors delaying the completion of the Fire Station 4 and 5 Project included the following:
1. Adverse weather days beyond the allotted contract-allowable days
2. Material delays adversely affecting the manufacture and delivery of brass fire poles
3. Utility installation delays with Evergy, AT&T, and Spire
4. Building gas pressure and soffit heating design item coordination delays
Impact/Analysis:
The addition of 40 days will allow for the completion of the City's contract with McCown Gordon Construction.
