Issue/Request:

An Ordinance approving Modification No. 1 to an Agreement for Professional Engineering Services for the Ward Road Improvements (NW O'Brien Road to NW Blue Parkway) Project (RFQ No. 2022-040) with Walter P Moore and Associates, Inc., for an increase of $106,670.00 for the amended Basic Services, with an amended not to exceed amount of $550,985.00, and authorizing the City Manager to execute an agreement for the same.

 

Key Issues:

                     The City and Walter P Moore and Associates, Inc. (hereinafter "Engineer") entered into an Agreement for Professional Engineering Services for the Ward Road Improvements (NW O'Brien Road to NW Blue Parkway) Project (RFQ No. 2022-040) dated April 27, 2022 (hereinafter "Base Agreement").

 

                     The City desires to modify the base agreement with Engineer to provide additional scope of engineering services during design.

 

                     The Engineer has submitted a proposal with estimated costs to provide additional engineering services.

 

                     The City desires to modify the Base Agreement, as amended, with Engineer as provided herein (hereinafter "Modification No. 1").

 

Proposed Committee Motion:

I move to recommend to City Council approving Modification No. 1 to an Agreement for Professional Engineering Services for the Ward Road Improvements (NW O'Brien Road to NW Blue Parkway) Project (RFQ No. 2022-040) with Walter P Moore and Associates, Inc., for an increase of $106,670.00 for the amended Basic Services, with an amended not to exceed amount of $550,985.00, and authorizing the City Manager to execute an agreement for the same. 

 

 

Proposed City Council Motion:

FIRST MOTION: I move for a second reading of an Ordinance approving Modification No. 1 to an Agreement for Professional Engineering Services for the Ward Road Improvements (NW O'Brien Road to NW Blue Parkway) Project (RFQ No. 2022-040) with Walter P Moore and Associates, Inc., for an increase of $106,670.00 for the amended Basic Services, with an amended not to exceed amount of $550,985.00, and authorizing the City Manager to execute an agreement for the same. 

 

SECOND MOTION: I move for adoption of an Ordinance approving Modification No. 1 to an Agreement for Professional Engineering Services for the Ward Road Improvements (NW O'Brien Road to NW Blue Parkway) Project (RFQ No. 2022-040) with Walter P Moore and Associates, Inc., for an increase of $106,670.00 for the amended Basic Services, with an amended not to exceed amount of $550,985.00, and authorizing the City Manager to execute an agreement for the same. 

 

 

Background:

Following a qualification-based selection process, Walter P Moore and Associates, Inc. was selected to perform the professional engineering services for the Ward Road Improvements project. The Base Agreement between the City and Engineer was executed on April 27, 2022. 

 

The City submitted the Ward Road Improvement project as a candidate for federal funding under the Missouri Transportation Alternatives Program.  The City was notified by the Missouri Department of Transportation (MoDOT) that the project was allocated federal funds on February 28, 2023.  The Ward Road Improvements project will require additional environmental review, documentation, and submittals to MoDOT to fulfill the requirements for federal funding.  Modification No. 1 includes additional scope and fee associated with the federal funding process.

 

Additionally, Modification No. 1 includes additional plan sheets that were determined to be necessary during the design process.  This includes demolition plans, concrete jointing plans, and detailed intersection layouts.  The additional plan sheets will also include plans for modification of an existing box culvert.  The Base Agreement included assessment of the existing culvert to determine whether repair, rehabilitation, or replacement would be implemented with the project.  After assessment, it was determined that the box culvert will be repaired and extended. 

 

Modification No. 1 also includes additional scope for sanitary sewer design.  During design, the Lee's Summit Water Utilities Department determined the need for a change in the layout of sewer mains within the project limits based on updated flow monitoring data.

 

Modification No. 1 includes additional right-of-way and easement exhibits and legal descriptions.  During design it was determined that additional right-of-way and easements would be required in excess of the amount included in the Base Agreement.  This is due to a change in the centerline required to avoid impacts to a water transmission main, changes in vertical profile to meet current design criteria, the inclusion of a water main easement along the length of the project, extension of the existing box culvert, and increased area at intersections to meet current requirements for curb radii and ADA ramps.
