AN ORDINANCE AUTHORIZING THE EXECUTION OF AN AGREEMENT BY AND BETWEEN THE CITY OF LEE’S SUMMIT AND THE SAVANNAH RIDGE PROPERTY OWNERS ASSOCIATION FOR UPGRADED STREET LIGHTING IN THE SAVANNAH RIDGE SUBDIVISION.

Issue/Request:

 

Savannah Ridge Property Owners Association (SRPOA) is requesting an additional street light for the Savannah Ridge Subdivision.  Additionally the SRPOA has asked about changing their 13 existing wooden street light poles to steel street light poles.

 

Key Issues:

Resolution No. 06-04 adopted standards for minimum street lighting requirements ("Standard Street Light Requirements").

The City leases this part of the street light system from Kansas City Power and Light and is billed monthly according to rates set by the Public Service Commission.

The SRPOA desires to install one additional street light at their cost.  This additional street light is above the quantity permitted in Standard Street Light Requirements, and the City will incur no additional costs from the installation of the additional street light.  The light would match the City's current standards referenced in Resolution 06-04.

The SRPOA has also inquired about changing 13 wooden poles (standards prior to Resolution 06-04) to steel poles (required by Resolution 06-04).  In the proposed Agreement the City would incur the additional costs of the upgrade request, $1,837.68 per year at current rates.

 

Proposed City Council Motion:

FIRST MOTION:  I move for a second reading of AN ORDINANCE AUTHORIZING THE EXECUTION OF AN AGREEMENT BY AND BETWEEN THE CITY OF LEE’S SUMMIT AND THE SAVANNAH RIDGE PROPERTY OWNERS ASSOCIATION FOR UPGRADED STREET LIGHTING IN THE SAVANNAH RIDGE SUBDIVISION.

 

SECOND MOTION:  I move for adoption of AN ORDINANCE AUTHORIZING THE EXECUTION OF AN AGREEMENT BY AND BETWEEN THE CITY OF LEE’S SUMMIT AND THE SAVANNAH RIDGE PROPERTY OWNERS ASSOCIATION FOR UPGRADED STREET LIGHTING IN THE SAVANNAH RIDGE SUBDIVISION.

 

Background:

By Resolution 06-04 the City adopted standards for public street lighting infrastructure ("Standard Street Light Requirements").  The Resolution includes standard design criteria, material requirements, base levels of lighting according to street classification and requirements for where street lights are located.

The leased lighting system has rates set by the Public Service Commission and is based on the capital cost of the light, its installation, its maintenance, and its energy costs.  The City pays for street lights that meet the requirements of Resolution 06-04.  Upgrades (such as decorative poles) or additional street lights can be installed provided the costs for these lights are not paid for by the City.

The SRPOA desires to install an additional street light that will match the City's current standards (a 150 watt sodium vapor light on a steel pole).

 

The SRPOA's request to change the 13 wooden poles to steel poles is:

1)  Allowed under the current standards and would merely bring the poles up to the current standards.

2)  An attempt to make the poles in the subdivision consistent.  Savannah Ridge Subdivision has 17 street light poles; 13 are wooden, and 4 are steel.  The new pole would be a steel pole.

 

The wooden poles were properly installed according to the City's previous street light requirements.  Steel poles are required by the current standards, and all costs associated with steel pole installations are paid for by the City.

 

Impact/Analysis:

This Agreement will require the Association to pay the City the full annual cost for one (1) street light which is in addition to the base level of lighting according to Resolution 06-04.  The City will bill the Association (at the current rates set by the Public Service Commission) on or before July 1 of every fiscal year.  These provisions insure that there is no additional cost to the City for the additional street light above and beyond the current standards.

If for any reason the Association desires to remove the additional street light, then the Association shall be responsible for all costs associated with the removal of the additional street light.

 

This Agreement will require the City to pay the difference per pole ($11.78 at current rates) for an annual cost of $1,837.68.  The City pays the lease costs of all the wooden and steel poles in the Savannah Ridge Subdivision that are in accordance with City standards.
