Issue/Request:

An Ordinance approving Modification No. 5 to an Agreement dated July 16, 2019 (RFQ No. 543-32272) for Professional Engineering Services for Four Stormwater Improvement Projects - SW Blazing Star Drive, SW 34th Street, NE Delta School Road, SW Pinnell Drive by and between the City of Lee’s Summit, Missouri, and Lamp Rynearson for an increase of $24,314.68 with an amended not to exceed amount of $379,714.68, and authorizing the City Manager to execute an agreement for the same.

 

 

Key Issues:                                         

                     The City and Engineer entered into an Agreement for Professional Engineering Services for Four Stormwater Improvement Projects - SW Blazing Star Drive, SW 34th Street, NE Delta School Road, SW Pinnell Drive (RFQ No. 543-32272) dated July 16, 2019 (hereinafter “Base Agreement”).

•    The City and Engineer modified the Base Agreement pursuant to Modification No. 1 dated January 7, 2020, to extend the design efforts at the SW 34th Street location.

•    The City and Engineer further modified the Base Agreement, as amended, pursuant to Modification No. 2 dated August 20, 2020, to extend the design efforts at the NE Delta School Road location.

•    The City and Engineer further modified the Base Agreement, as amended, pursuant to Modification No. 3 dated December 28, 2020, to provide design for four additional project sites to be known as "Stormwater Improvements - Phase 2" - NW Ponderosa Street, NE Country Lane, NE Pierce Place, and NE Arlington Circle.

•    The City and Engineer further modified the Base Agreement, as amended, pursuant to Modification No. 4 dated August 19, 2021, to extend the design efforts at the NE Arlington location.

•    The City and Engineer desire to amend the provisions of the Base Agreement, as amended, as provided herein.

•    The Engineer has submitted a proposal for the amended engineering services and an estimate of engineering costs to perform said services. 

•    The City Manager is authorized and empowered by City to execute contracts providing for professional engineering services. 

 

 

 

Proposed City Council Motion:

FIRST MOTION: I move for a second reading of An Ordinance authorizing execution of Modification No. 5 to the agreement dated July 16, 2019 (RFQ No. 543-32272) for professional engineering services for stormwater for 4 projects with Lamp Rynearson, for an increase of $24,314.68 with an amended not to exceed amount of $379,714.68 and authorizing the City Manager to execute an agreement for the same.

 

SECOND MOTION: I move for adoption of An Ordinance authorizing execution of Modification No. 5 to the agreement dated July 16, 2019 (RFQ No. 543-32272) for professional engineering services for stormwater for 4 projects with Lamp Rynearson, for an increase of $24,314.68 with an amended not to exceed amount of $379,714.68 and authorizing the City Manager to execute an agreement for the same.

 

 

Background:

On July 28, 2023 Lamp Rynearson submitted sealed bid plans and specifications for the design of Stormwater Improvements - Phase 2.  Plans include improvements to the public storm sewer systems at three locations.

 

The City has advertised and concurrent to this modification will consider the construction award of Stormwater Phase 2 project to Legacy Underground Construction, Inc.  The Contractor will be required to submit shop drawings from fabricators and materials certifications from suppliers that must be reviewed by Lamp Rynearson to ensure conformance with the project's plans and specifications.  Other engineering support during construction will include plan revisions as needed based on actual conditions in the field, reviewing change orders, answering questions related to the project design, attending periodic construction progress meetings, participating in the substantial completion walk-through, and prepare post-construction record drawings for City records.

 

The contract for design services authorized a fee up to $355,400 that consisted of basic and optional services.  This modification for construction services will authorize a total fee up to $379,714.68.

 

Impact/Analysis:

This agreement will allow Lamp Rynearson to provide the City with Submittal Review of the items identified in the background section.  Not having appropriate engineering services during construction does not follow current standards of practice for engineering and construction quality assurance.

 

Timeline:

Estimated contract start date for the Ponderosa Street site could be as early as October 2023.

Estimated contract start date for the Country Lane and Arlington Circle sites is expected to be March 2024.

Each site will have individual milestone dates.

The project will be substantially complete by the end of August 2024.
