An Ordinance approving the Petition for Establishment of the View High Sports Complex Community Improvement District

Issue/Request:
This is an ordinance that would approve a community improvement district for the View High Sports Complex to provide reimbursement for eligible public improvement costs associated with the project to be constructed by the company 3D Builders KC, LLC (the “Developer”), as the Developer of the View High Sports Complex Project.
Key Issues:
Developer is requesting that the City approve incentives through the formation of a community improvement district which would impose a 1% sales and use tax on the proposed project area to generate revenues to reimburse the Developer for eligible public improvement costs.
Background:
On March 18, 2025, the City Council held a public hearing to consider a rezoning for the Project from District AG (Agricultural) to District CP-2 (Planned Community Commercial) and Preliminary Development Plan for View High Sports Complex on approximately 17.18 acres of land located at 3350 NW Ashurst Drive.
At the March 18, 2025 Council meeting, the City Council also heard a conceptual presentation about the incentive request presented by Developer. A majority of the City Council expressed an interest in considering the incentive request through the formal Chapter 100 process and the process governing the companion CID petition through the Community Improvement District Act. The City Council did not vote or render any type of final or binding decision as part of the conceptual presentation.
On April 15, 2025, the City Council approved Ordinance No. 10118 which approved the rezoning and preliminary development plan for the Project.
On April 22, 2025, the City Council approved Ordinance No. 10121 which approve the Funding Agreement between the City and Developer for the Project to fund the work associated with the City’s consideration of the incentive request.
The Project consists of a sports and entertainment complex to be located on approximately 17 acres of land situated to the southeast of the intersection of View High Drive and Chipman Road in the City (the “Project Site”). On the Project Site, the Company plans to construct, equip, furnish and develop:
(A) an approximately 180,000 square foot indoor athletic complex which includes six basketball courts; 12 volleyball courts; a FIFA regulation size soccer field, a 10,000 square foot family entertainment center with arcade, golf simulators and active play area; 6,000 square feet of medical office space that will be occupied by a physical rehabilitation group; a 6,000 square foot speed and agility training area; 4,000 square feet of athletic club office space; 1,800 square feet of merchandise store space for athletic clubs and a cafe;
(B) an approximately 90,000 square foot outdoor athletic complex which is comprised of a FIFA regulation sized soccer field and 5 pickleball courts (altogether, the “Project”).
As part of the Project, the Company will also construct a connector road, including all signalization and related sidewalks, curbing and guttering, and other public infrastructure including the extension of required utilities related to the main Project components (the “Public Improvements”), which Public Improvements may be located on or near the Project Site.
Impact/Analysis:
The new sales tax will generate revenues to reimburse Developer for eligible costs. The financial impact to the City is set forth in the Cost Benefit Analysis which is included in the meeting packet. The imposition of a new 1% sales tax on the Project Site is not expected to impact any other property in the City.
Developer proposes to use the CID revenue to fund the following Project cost items:
• View High left turn lane
• Streets, sidewalks and traffic signage
• Stormwater and Regional Detention
• Utilities
• Parking Lots
• Parks, Lawns, Trees and Landscaping
• Marque Signage
• Construction management and soft costs for the public improvements

Other Information/Unique Characteristics:
This is the first privately-owned sports complex project that has requested incentives from the City. As such, this request raises unique issues that are not presented by more traditional commercial areas that have previously received incentives from the City.
