Public Hearing: Application #PL2024-218 - Vacation of Right-of-Way - A portion of SW Jefferson Street right-of-way and miscellaneous right-of-way located south of SW Oldham Parkway (abutting 101 SW Oldham Parkway); and a portion of SW Market Street north of SW Persels Road (abutting 1300, 1302 and 1304 SW Market Street); Engineering Solutions, LLC, applicant.

Issue/Request:

The applicant proposes to vacate the subject rights-of-way in association with the future Oldham Village redevelopment project on the former Adesa Auto Auction site and adjacent vacant commercial and industrial sites in the vicinity of the SW Jefferson St and SW Oldham Pkwy intersection.   Area road improvements associated with the Oldham Village redevelopment project include realigning an approximately 580’ long section of SW Jefferson St south of SW Oldham Pkwy and removal of SW Market St north of SW Persels Rd.  The subject rights-of-way will no longer serve a public purpose and will revert to private property.  Right-of-way for the realigned portion of SW Jefferson St will be dedicated via plat under separate applcation.  No objection to the proposed vacation of right-of-way has been raised by any private utility, the City’s Public Works or Water Utilities Departments.

Recommendation

Recommendation: With the conditions of approval below, the application meets the requirements of the UDO and Design and Construction Manual (DCM).

1. The vacation of the portion of SW Jefferson St right-of-way shall not go into effect until such time as the City accepts the public improvements for the realigned intersection of SW Jefferson St and SW Oldham Pkwy(revised by staff)

2. The vacation of the portion of SW Market St right-of-way described as Tract A shall become effective immediately. (added by staff)

3. The vacation of the portion of SW Market St right-of-way described as Tract B shall not go into effect until such time as the private drive providing access to 1304 SW Market St from SW Jefferson St is constructed and the affected segment of SW Market St pavement is removed.  (added by staff)

On a motion by Ms. Frazier, seconded by Mr. Benbrook, the Planning Commission unanimously voted on March 13, 2025, to recommend approval of Appl. #PL2024-218 - VACATION OF RIGHT-OF-WAY - A portion of SW Jefferson St right-of-way and miscellaneous right-of-way located south of SW Oldham Pkwy (abutting 101 SW Oldham Pkwy); and a portion of SW Market St north of SW Persels Rd (abutting 1300, 1302 and 1304 SW Market St); Engineering Solutions, LLC, applicant.
