Issue/Request:
An Ordinance approving a Sole Source agreement for Professional Engineering Services for the Remington Woods Stormwater Project by and between the City of Lee's Summit, Missouri, and Wilson & Company, Inc., in the amount of $128,078.00 and authorizing the City Manager to execute an agreement for the same.
Key Issues:
• A property owner in the Remington Woods subdivision has certified structural flooding in writing
• Following an evaluation by the Public Works engineering staff, one of the primary causes of the structural flooding was the lack of public infrastructure and/or failed public infrastructure
• Wilson & Company, Inc was previously contracted to conduct topographic surveying work in the area for City Staff to evaluate potential capital improvement to public infrastructure to the reduce the risk of structural flooding
• City staff does not have the availability to complete engineering design work in-house in a timely manner, so an engineering firm is needed to complete the project
• The firm’s previous work in the area gives them specialized knowledge for this project which will result in significant monetary and time savings
• This project is funded from the CIP Sales Tax Renewal Fund that was approved by voters in April 2017 and became effective April 1, 2018

SECOND MOTION: I move for adoption of an Ordinance approving a Sole Source agreement for Professional Engineering Services for the Remington Woods Stormwater Project by and between the City of Lee's Summit, Missouri, and Wilson & Company, Inc., in the amount of $128,078.00 and authorizing the City Manager to execute an agreement for the same.
Background:
Stormwater management has been an ongoing discussion within the City for many years. For nearly the last three decades, Public Works has completed a number of initiatives to address flooding within the City. These include stormwater master planning from 1997 to 2002, development of a Citizen Stormwater Task Force in 2004, a voter approved bond issue in 2007, and a voter approved 15-year extension of the Capital Improvement (CIP) Sales Tax in 2017. Recently, the City has received additional funds through an ARPA Grant through the Missouri Department of Natural Resources (MDNR).
The 2002 planning study, 2004 Task Force, 2007 bond issue and 2017 CIP Sales Tax addressed flooding caused by a lack of public infrastructure or failing infrastructure. At the time of the 2007 bond issue, property owners were required to submit a written statement that their residence or business flooded. Over 47 properties were confirmed in writing and City staff verified that those properties incurred structural flooding due to a lack of public infrastructure. By 2016 the City constructed over three dozen stormwater improvement projects throughout the City. Since the 2017 CIP Sales Tax was approved, a list of 21 locations affecting 34 structures has been identified. Construction has been completed for 17 locations, one location is currently under construction, and three locations will begin construction in 2025. In addition to structural flooding projects, the City has constructed five streambank projects to protect public roadways, mitigated a repetitive roadway flooding issue to allow emergency access during heavy rains, and purchased two properties located in flood hazard areas mapped by FEMA that suffered repetitive flooding. City staff continues to update the tracking spreadsheet as new flooding issues are reported and confirmed.
The Remington Woods Stormwater Project will reduce the risk flooding impacting structures due to the lack of public infrastructure in the area. In addition to mitigating structural flooding, the Remington Woods Stormwater Project will significantly reduce flooding in City Right-of-Way along NW Shady Bend Lane. This project is being funded through the 2017 CIP Sales Tax Fund.
City staff has recently designed projects like this in-house. However, due to the lack of available staffing, the project would have to be delayed at least one year. Such a delay increases the risk for repetitive flooding the same area until the infrastructure is improved to better convey stormwater in this neighborhood. Therefore, City staff recommends hiring an engineering design consultant to complete the project in a more timely manner.
Impact/Analysis:
This agreement will allow Wilson & Company, Inc. to provide engineering services to the City to complete the project in a timely manner.
