Issue/Request:
An Ordinance approving a Temporary Construction License (License No. DACW41-3-25-0043) Agreement between the City of Lee’s Summit, Missouri, and the United States Army Corps of Engineers to enter upon property for the reconstruction of the Sampson Road Bridge over Mouse Creek located on government-owned land, and authorizing the Mayor to execute the same.
Key Issues:
• The City and the United States Army Corps of Engineers desire to enter into a Temporary Construction License agreement to grant temporary easement on Corps property for the construction of the Sampson Road Bridge Project.
• Since this is an Intergovernmental Agreement (IGA) between the US Government and the City, the Charter and State Statute require it to be passed as an Ordinance and signed by the Mayor.
Proposed City Council Motion:
I move for adoption of an Ordinance approving a Temporary Construction License Agreement between the City of Lee’s Summit, Missouri, and the United States Army Corps of Engineers to enter upon property for the construction of the Sampson Road Bridge project, and authorizing the Mayor to execute the same.
Background:
The United States Corps of Engineers has submitted to the City a Temporary Construction License Agreement for signature. Since this is an Intergovernmental Agreement (IGA) between the US Government and the City, our Charter and State Statute require it to be passed as an Ordinance and signed by the Mayor.
Pursuant to Ordinance No. 9648 and 10045, the City entered into an Agreement with Wilson & Company for the design and construction inspection services of the Sampson Road Bridge Project (997). The design of the project requires a temporary construction easement on the US Corps of Engineers property. Easements are issued through the Real Estate office of the US Army Corps of Engineers and the process is lengthy and would have significantly delayed the bidding of our project. However, in the letter dated November 4, 2024, the United States Army Corps of Engineers granted access to the property for construction of the project with an understanding that the Real Estate Division was in the process of drafting the easement for the work and would provide such agreement to the City at a later date. Pursuant to Ordinance No. 10036 the City entered into an Agreement with Radmacher Brothers Excavation, Inc for the construction services for the project. Construction of the project began in February, 2025.
Impact/Analysis:
Upon approval, USACE will be able to officially grant temporary easement for the construction of a the City's Sampson Road Bridge project.
