Issue/Request:
AN ORDINANCE AUTHORIZING THE EXECUTION OF A LICENSE AGREEMENT BETWEEN JOHN KNOX VILLAGE, INC. AND THE CITY OF LEE'S SUMMIT, MISSOURI, FOR THE INSTALLATION AND MAINTENANCE OF IMPROVEMENTS TO A PORTION OF THE CITY'S RIGHT-OF-WAY ON MURRAY ROAD.
Key Issues:
- John Knox Village is proposing to relocate the existing monument sign from its current location, which is adjacent to the John Knox Village Courtyards driveway, to the the next drive entrance north on Murray Road to better identify with the Pavilion.
- The City's right-of-way extends approximately 60 feet west of the paved surface. Locating the sign outside of the right-of-way would result in it not being viewable from the street.
- John Knox Village has asked permission to construct the monument sign within the City's right-of-way for Murray Road in order for the monument sign to be visible.
- The construction and maintenance of the monument sign and landscaping is subject to a license agreement.
Proposed City Council Motion:
I move for a second reading of AN ORDINANCE AUTHORIZING THE EXECUTION OF A LICENSE AGREEMENT BETWEEN JOHN KNOX VILLAGE, INC. AND THE CITY OF LEE'S SUMMIT, MISSOURI, FOR THE INSTALLATION AND MAINTENANCE OF IMPROVEMENTS TO A PORTION OF THE CITY'S RIGHT-OF-WAY ON MURRAY ROAD.
I move for adoption of AN ORDINANCE AUTHORIZING THE EXECUTION OF A LICENSE AGREEMENT BETWEEN JOHN KNOX VILLAGE, INC. AND THE CITY OF LEE'S SUMMIT, MISSOURI, FOR THE INSTALLATION AND MAINTENANCE OF IMPROVEMENTS TO A PORTION OF THE CITY'S RIGHT-OF-WAY ON MURRAY ROAD.
Background:
John Knox Village currently has a monument sign with electronic message board and is used to provide information on upcoming events at the Pavilion. The sign is currently located along Murray Rd adjacent to the drive entrance now being used as the main entrance for the Courtyard facilities. The drive entrance to the north on Murray Road will be now be utilized as the main entrance for the Pavilion. While the normal right-of-way depth extends 11 feet from the back of the curb or pavement, the right-of-way at the proposed location extends approximately 60 feet from the Murray Road pavement. Placement of the monument sign with electronic message board beyond the right-of-way on private property would greatly reduce its effectiveness.
Such an encroachment into the right-of-way is subject to the City's standard license agreement.
The proposed license agreement provides sufficient area for the location of the monument sign and landscaping.
Impact/Analysis:
There is no real impact on normal municipal operations due to the approval of the license agreement. It is consistent with other agreements currently in place.
Timeline:
Work would begin as soon as possible.
