AN ORDINANCE APPROVING EXECUTION OF AN ATTESTATION OF FINANCIAL RESPONSIBILITY AND FOR THE REDESIGNATION OF THE CITY MANAGER AS “AUTHORIZED OFFICIAL” PERTAINING TO THE CITY’S STATUS AS A MEDICARE SUPPLIER.

Issue/Request:

AN ORDINANCE APPROVING EXECUTION OF AN ATTESTATION OF FINANCIAL RESPONSIBILITY AND FOR THE REDESIGNATION OF THE CITY MANAGER AS “AUTHORIZED OFFICIAL” PERTAINING TO THE CITY’S STATUS AS A MEDICARE SUPPLIER.

 

 

Key Issues:

The City's Fire Department, as a provider of emergency medical services ("EMS"), is currently a Medicare Supplier.

The City's status as a Medicare Supplier allows the City to directly bill and receive payments from Medicare and Medicaid directly for EMS services it renders to the public.

The City is in the process of revalidating its status as a medicare Supplier with the Centers for Medicare and Medicaid Services ("CMS").  The revalidation process occurs every five years. 

The Medicare Enrollment Application (form CMS-855B) the City's Fire Department is completing for the revalidation of its status as a Medicare Supplier requests a letter attestation stating the City will accept legal and financial resposnbility in the event of any outstanding debt owed to CMS, including potentional overpayments by Medicare. 

The City further requests the City Council redesignates the City Manager as the "authorized official" of the City pertaining to the City's status as a Medicare Supplier.  The "authorized official" as defined by CMS is the official with authority to enroll the City in the Medicare program, to make changes and updates to the City's status in the program and to commit the City to fully abide by the statutes, regulations, and program instructions of the medicare program.   The "authorized official" may further designate "delegated officials" that would have authority to make updates and changes to the City's status in the Medicare Supplier program, such delegated officials would be the Chief (Chief Rick Poeschl) and an Assistant Chief (Asst. Chief Dan Manley) of the Fire Department.

I move for second reading of AN ORDINANCE APPROVING EXECUTION OF AN ATTESTATION OF FINANCIAL RESPONSIBILITY AND FOR THE REDESIGNATION OF THE CITY MANAGER AS “AUTHORIZED OFFICIAL” PERTAINING TO THE CITY’S STATUS AS A MEDICARE SUPPLIER.

I move for adoption of AN ORDINANCE APPROVING EXECUTION OF AN ATTESTATION OF FINANCIAL RESPONSIBILITY AND FOR THE REDESIGNATION OF THE CITY MANAGER AS “AUTHORIZED OFFICIAL” PERTAINING TO THE CITY’S STATUS AS A MEDICARE SUPPLIER.

Committee Recommendation: The City did not receive notice to revalidate its Medicare Enrollment record until January 13, 2017.  The City's claims for Medicare payments were placed on hold as of December 31, 2016.  The City now has 60 days to complete the revalidation to obtain payments on claims for 2017.  Due to the need to submit the revalidation materials by the end of February and there being no regularly scheduled city council meeting after February 16; this ordinance is being sent directly to the City Coucil for consideration and approval.
